Abstract
Since its creation in 1990, the SUS has consistently advanced in providing universal and integrated health care for the Brazilian population, contributing to reducing disparities in access to health and achieving better results, but it presents major challenges. Human needs are endless while public resources are scarce, so public authorities must make choices when implementing public policies. This study aims to draw some outlines on the reserve of the possible, a methodology of the bibliographical review type was used, through data from the VHL. The reservation of the possible, in its various dimensions, can function as a limit (legal and factual) to the right to health protection and promotion and, therefore, to judicial control in this area, but also as a mechanism for strengthening health in terms of the health system. of care. It was possible to observe that social rights represent second-generation guarantees and demand positive actions from the state apparatus so that they are factually assured in the lives of their holders. The judicialization of health, which, if not addressed in an intersectoral way and considering the best available evidence of effectiveness, will represent a significant threat to the sustainability of health systems.
