THE LEGAL AND INSTITUTIONAL IMPACT OF THE IMPLEMENTATION OF ENVIRONMENTAL LICENSING BY ADHESION AND COMMITMENT (LAC)
Abstract
The growing concern with the environment and the need to protect natural resources essential for human survival, has driven the creation of legislation and public policies that aim to minimize the environmental impacts caused by economic activities. In view of this, this article aims to analyze the legal and institutional impact of the implementation of environmental licensing by adhesion and commitment in environmental protection. This type of licensing consists of prior authorization granted by the environmental agency for activities of low environmental impact, provided that the entrepreneur complies with previously defined environmental commitments. Thus, we seek to understand whether this licensing modality is efficient in environmental protection and whether it has advantages over the traditional model. In view of this, it is concluded that LAC can be an important tool for environmental protection, provided that it is implemented in a responsible and efficient manner, with the participation of society and the guarantee of transparency and technical-scientific rigor in the analysis and granting of environmental licenses.
