A nova lei de licitações e contratos administrativos: impactos na agricultura familiar brasileira

Abstract

The Public Administration contracts services and acquires products through the bidding process, defined by law. However, the legislation provides for hypotheses in which the Administration can purchase products without the need for bidding. One of these hypotheses is accreditation, expressly provided for in Law No. 14,133/2021, called the New Bidding Law. Accreditation can be used to facilitate the acquisition of family farming products, given that farmers need to sell surplus production, while public management needs to acquire food to maintain the functioning of institutions and the provision of services to the population. The present study was developed with the objective of analyzing the impacts of the legal application of Law No. 14,133/2021 on Brazilian family farming, enabling a less bureaucratic and more efficient route through an educational booklet with guidance on the accreditation of farmers with the Municipal Public Administration. A bibliographic study was carried out, with a qualitative approach, based on the analysis of legislation, doctrine and studies on the topic. It was found that the New Bidding Law can contribute to accreditation being increasingly used as an instrument in contracts between the Public Administration and small family farming producers. Thus, farmers can contact local public bodies and request information about accreditation, encouraging institutions and municipal governments to organize administrative routines and procedures for the acquisition of agricultural products
