Objective interpretation of contracts in economic freedom law - The new era of Brazilian law
Abstract
Faced with changes in the legal system about Lei de Liberdade Econômica in Brazil (Economic Freedom Law), and the pandemic situation faced later, it is necessary to analyze the historical events that directly reflected changes in States, where the effects of COVID-19 certainly had a direct impact , since changes in the position of the contractors were required in order to maintain the signed business, including the contemporary aspects inherent to the theory of unpredictability and its unrestrained application by law operators. It is important to emphasize the possibilities in legislation, with a focus on the express provision of the parties to modify the interpretative model of their contracts, with freedom among the contractors being prestigious, as long as social and environmental aspects are respected, which can be discarded by an interpretation that does not be guided by the will of the parties, but by what was obtained signed based on the animus expressed in the contracts. We will also verify whether such legislative changes can in fact impact aspects of economic development, especially with a resumption of this important sector, even though we are still facing a COVID-19 pandemic
