FEASIBILITY OF THE IMPLEMENTATION OF PRIVATE LANDFILLS UNDER THE REGULATORY PRISM OF THE STATE OF PARAÍBA AS TO ENVIRONMENTAL LICENSING
Abstract
ABSTRACTThe article analyzes the feasibility of environmental licensing for the implementation of private landfills in Paraíba. The increase in urban population reflects directly on the increase in the production of Municipal Solid Waste. The research aims to evaluate the normative permissiveness and the legal viability of environmental licensing for the implantation of private landfills in the State. The methodology adopts the Documentary and Bibliographical research, taking as a base the state legislative sources, besides federal norms, from CONAMA and SUDEMA. We saw that the Environmental Legislation, in the federal sphere is ample and complete, however, when we observe the legislation of the State of Paraíba about environmental licensing for implantation, operation and maintenance, we verify that it is inexistent. Finally, this paper pointed out the absence of state rules about the licensing of landfills, as a consequence, the procedure remains shrouded in legal uncertainty, in addition to unreasonably expand the discretion.
