A reincidência criminal como consequência da precariedade do sistema carcerário brasileiro

Abstract

In the contemporary world, the lack of penitentiary policies aimed at re-socialization, as well as the precariousness of the Brazilian prison system, expressed in violence, overcrowding, unhealthy conditions, and lack of assistance, point to the non-fulfillment of the social function of prisons. Knowing the importance of carrying out the social function of prison, this article aims to debate and understand to what extent the precarious conditions to which prisoners are subjected contribute to the occurrence of criminal recidivism. Through the deductive and comparative method, in basic, qualitative, explanatory, and bibliographic research, based on data content analysis, this work shows the importance of education and professional qualification for the prevention of criminal recidivism, such as the violence of the State, expressed in non-compliance with Human Rights, leads to disorder in the penitentiaries and which prison models have obtained low rates of recidivism, through cultural and educational projects. In addition, work and sport can contribute to the effectiveness of the prison system, thus preventing criminal recidivism.
