Abstract

his article seeks to reflect on the (un)constitutionality of article 191 of the Criminal Procedure Code, from a constitutional perspective on the topic. The article aims to demonstrate that the aforementioned article violates constitutional provisions, in particular, the broad defense and contradictory provisions. The doctrinal position on the topic regarding broad defense and jurisdiction over the constitutionality or otherwise of the article were used as theoretical references. Based on jurisprudential research, it was found that the understanding prevails that the article under comment is compatible with the constitutional order. After doctrinal and jurisprudential analysis, this author argues that the inclusion of the presence of the accused during the interrogation of the court is not compatible with the principles of broad defense and adversarial proceedings.
