Abstract

The present work seeks to analyze the role of the Federal Senate in the diffuse-concrete control of Brazilian constitutionality, through the documentary analysis of the doctrine on the subject. Initially, the research intends to study the institute of constitutional mutation, defining concepts and limits based on the dominant doctrine. Then, the work addresses the evolution of the reading of article 52, X, of the Federal Constitution in the face of an alleged constitutional mutation, analyzing different positions on the subject, and analyzing the current role of the Senate in the control of constitutionality. In the conclusion, it is verified that mutation presents itself as an important mechanism for updating the Constitution in the face of social dynamism, but that, even so, it must observe certain limits and criteria. It is also concluded that article 52, X, of the Federal Constitution has undergone a process of mutation, which, despite doctrinal criticisms, requires a rereading of the provision. The work uses the method of literature review and documentary research, through descriptive research and qualitative approach to the data obtained.
