Corporate protection of pathological gamblers and gambling disorder: gambling compliance under Law No. 14,790/2023

This bibliographical research, using the deductive and comparative law method, aims to analyze the effectiveness of the gambling compliance institute as a mechanism for corporate protection of pathological gamblers and gambling disorder within the scope of Law No. 14.790/2023. To achieve this objective, the article will be designed as follows: (i) initially, we will promote a general dogmatic analysis of Law No. 14.790/2023, observing the concepts outlined, as well as the rights and duties understood by users and companies and the sanction inspection mechanisms by the Brazilian State; (ii) then, we will make a specific cut on the treatment of pathological gamblers and gambling disorder, emphasizing possible shortcomings on the part of the legislation in conflict with its intention in view of preventive and prohibitive provisions; (iii) finally, we will analyze the classification of gambling compliance as an integrity tool to be adopted by companies in view of the state inspection mechanisms of the activity on the protection provided to pathological gamblers and those with gambling disorder. In terms of final considerations, we will indicate the main conclusions obtained from the research, as well as potential directions for future studies on the topic.
